Terms of Service

What to Consider

I reserve the right to refuse a sale for any reason. Reasons include, but are not limited to: shops that do not use platinum cure silicone, that do not degas their silicone, has advertised, or otherwise catered to, feral descriptions and/or designs.

I will not sell to private buyers that do not have a shop or are still in the works of setting up. I will only sell to established shops that have been in production a minimum of 6 months - a year at my discretion. 

Payment 

I will only do holds until the following Friday, during which time I will turn away any other offers for the same model. If payment isn't provided I will contact the next interested or it will be made available again and you may not put a hold on that model again. I will offer longer holds if a nonrefundable deposit of half the listed price is paid, there will be a 10% interest fee for each month the other half is not paid.

Payment is due upfront and will be done through PayPal invoice. As stated on most product listings, payment includes a final physical product copy of each model purchased, or copies depending on final size, in the size, colors, preferably glow, and firmness of my choice, within reason of your capabilities. I may offer discounts if I like your pour/hand painting style and request an attempt at recreating my choice of colors presented on the product listing or a certain named pour from your own shop with my pick of the batch.

Before payment I need to know your preferred file type to make sure I have it ready and that there's no importing issues. Upon completion of payment I need to know the following: an email I can send the file to, how you would like the purchase to be announced; which account needs to be tagged, if you’d like to remain anonymous until production is completed, any website link to use, etc. 

Final product copies are expected to ship within 90 days of sale and public announcement, unless contacted with reasons for delay and reaching an agreed extension date by both parties. Upon failure of fulfilling this obligation you will be charged, at minimum, the cost equivalent in USD of the final product of each copy owed. 

All sales are final. I do not accept “returns” and do not process refunds unless there was a failure on my part to deliver the file in the agreed upon format or an alternative workable file type. Should a chargeback be filed at any point, you agree that you forfeit any rights you were given upon original purchase, not limited to: commercial rights to produce and sell the model, and anything inspired by it. You will never be able to purchase a design from me again and your shop will be publicly named for the chargeback as a precaution to other artists.

Permissions

Upon purchasing a model from me, you and your shop have exclusive rights to produce and sell any commercial products made from it. I will not resell the model file while in production by you. You may not resell, redistribute or transfer rights of the model without first contacting me for permission. In the event you have plans to discontinue your shop and/or the model, please contact me about whether or not you'd like to transfer the rights back to me or another shop.

I’d greatly prefer having the rights transferred back to me instead of completely retiring the model. Should you transfer rights back to me, although not required I request that if you made any alterations to the file that I have it shared with me. The model may be put back up for sale at a discounted price with a note on the product listing mentioning your shop, ex: "Previously produced by (your shop name)" or will be kept in my sold catalog with a "discontinued" note with the previous mentioned.

Should you wish to transfer rights to another shop, I must be contacted first to approve whether or not I'd want them to be selling my designs. They will be charged a very small fee from myself agreeing to my TOS and to keep record of the rights transfer. Should you wish to sell them the model's file you made alterations to, product molds, any artwork, etc, of anything produced by yourself, that transaction is between you and the other shop. 

Unless otherwise noted on the model's listing, names may be changed as well as character descriptions and artwork. You may keep and/or expand upon any descriptions I made for that model. You may make minor edits to the design for easier production: smoothing sides, filling small gaps, etc. If possible I'd like to know these changes just to help my future designs to create less work for buyers. Any plans for major changes I must be contacted first, I'd like to stay as close to my original idea as possible, but I'm always open to ideas on how it could be improved to make both of us happier with it.

Pricing 

My pricing is based on what I think to be fair, both to myself and buyers, based on my time spent on it, my current skills with the look of what I list as the final model, and the complexity of it. Currently single squish designs may range from $60-$120, and single full model designs may range from $120-$300. Penetrable and grinder designs may have exceptions. Penetrable prices may be higher as I would have no use for a physical copy, unless the design has the possibility to be a mini it may be discounted instead with a copy as part of payment; that decision is up to the buyer before payment. These are subject to change at any time.

General discounts with alternate payment in the form of other products currently sold by the shop may be discussed. 

Editing and Printing

Upon request I'll try my best to make any of the small edits previously mentioned, any larger or more significant edits I may charge extra for should I agree to the changes.

Although I try my best, I have no experience with 3D printing and cannot guarantee models to be print ready or lend any knowledge to help with the process. 

My Usage and Credit

I reserve the right to display and share images of the digital model files purchased as my own work.

I must be credited in the description of the final product page either as LeoRat or my twitter handle @leoratninja 

Commissions 

I do not currently offer model commissions, but if someone is interested enough feel free to contact me and we can figure something out.
